Mediation is a process which is encouraged by the courts before making a claim, it involves all parties involved in a dispute sitting down and discussing potential solutions with an independent and neutral mediator, which helps the parties achieve a course of action and a binding agreement which all parties must uphold.

There is now an expectation from the courts that the legal teams representing the parties involved in the dispute will attempt mediation first before approaching court action, to avoid large court fees and uncertain outcomes.

The amount of time spent mediating will largely depend on the complexity of the issue and the individual parties involved, usually this can range from one day to three or four.

Unfortunately incidents of mortgage fraud still arise. We recently acted for a client whose property in Peterborough had been let by him. He was resident outside the company and whilst he was away a fraudster orchestrated a plan to secure the transfer of a number of properties, including that of our client, into the name of a company operated by him and then with the benefit of that portfolio of properties to negotiate a funding arrangement with a national bank for sums in excess of £1.4 million.
