Dockerill & Healey v Tullett

Matthew Hoe of Taylor Rose TTKW acted for the successful parties in three linked cases in which the Court of Appeal has limited children's ability to recover costs in low value personal injury claims. In Dockerill & Healey v Tullett, the Court of Appeal dismissed the claimants’ appeal against an order that the detailed assessment had to be conducted afresh on the basis that the normal track for the claimants’ claims was the small claims track (their damages were £750 each) and the court should consider whether a lawyer was required for each element of the claim for costs.
