Acting for the Lender

Acting for the Lender

Lenders are frequently removing law firms in a bid to reduce the size of their panel, many using the CQS accreditation as the justification. Both HSBC and Santander are recent examples of the new changes. Other major lenders have also started to follow this trend.

This means firms without CQS will not only find representing their client difficult, but find their ability to take instructions from new clients impaired. This is why we have devised a service that will ensure firms without CQS, inhibited by these new and restrictive criteria, will not suffer.

As a CQS accredited firm we have introduced a service which for a fixed fee means we will carry out acting for the lender on your behalf, allowing you to provide a comprehensive service for your clients and remain unhindered by the new requirements set by all major lenders.

It’s a cost effective service that allows firms without CQS to continue to work with clients to their best capabilities, with the assurance of successful and efficient transactions unaffected by new stringent lender requirements.

For more information please contact our property department head and partner Antony Jaggard on 01733 333 333.

Since new stringent rules from lenders now require all firms acting for a client to be CQS accredited, firms with property departments who have unfortunately not been able to meet the necessary conditions of the scheme have suffered, and seen many otherwise thriving property departments depleted and no longer able to act.

The Conveyancing Quality Scheme (CQS) is an accreditation from the Law Society that provides a recognised standard for conveyancing practices, and offers credibility and confidence to both lenders and clients.

In the first stages of application, the scheme requires firms to undergo an application process which tests every aspect of a conveyancing department and its staff, with training of staff from support to fee earner level, implementation of various security processes such as money laundering checks, and the strict following of the client service charter.

Each twelve months a firm must apply for re-accreditation and prove they still meet the requirements necessary to be a member of the scheme.

The scheme benefits both firms and clients alike, ensuring the following.

  • An efficient and high quality service
  • A standardised level of expectations for firms to uphold, providing clear objectives
  • Staff which are of a higher level of qualification and experience
  • Recognition of quality for firms from clients, insurers and lenders

Taylor Rose TTKW has received a great deal of recognition for the quality of our conveyancing department including the CQS accreditation, and can assist other firms with acting for the lender should they be unable to meet all the CQS criteria.

At Taylor Rose TTKW we have an experienced property department dealing with both new build, residential and commercial instructions.

Not only are we CQS accredited but our property department has received multiple awards, including the conveyancer of the year award; meaning you can be assured that you are handing over this aspect of the conveyancing transaction to experts in the property industry.

By choosing us to act for the lender on your behalf your property department can continue to thrive and grow, we guarantee swift turnaround and regular reporting of progress to keep you updated throughout, so you are always aware of the important details.

We can act for the lender for a small fixed fee and would be happy to discuss this further should you feel this service can benefit your firm.
