• Procurement advice - we assist with strategy, analysis, and allocation of risks, including design liability, delays, errors in documents, and change management.

• Construction contracts - drafting, review and negotiation of contracts.

• Development - including deal structure, land acquisition, project finance and construction obligations contained in forward funding agreements.

• Regulatory compliance - including the Construction (Design and Management) Regulations 2015, the Building Safety Act 2022, Environmental and Planning laws and regulations (CDM 2015; BSA 2022).

At instruction we provide a route map: early risk audit, Construction Act alignment on payment/adjudication, and, if disputes arise, pre‑action strategy, adjudication readiness, or litigation planning in the Technology amd Construction Court ("TCC") with clear budget ranges.

Recent client instructions

• Cladding defects adjudication - advising a property developer client, as referring party, in an adjudication claiming c.£1m in costs and damages arising from defects, caused by poor design and/or workmanship, in the façade of higher-risk buildings (routes may include contract, negligence, and, for residential schemes, Defective Premises Act claims as extended by the Building Safety Act 2022, subject to facts and limitation) (BSA 2022).

• Redevelopment of a shopping centre - advising the main contractor on a design and build contract for the redevelopment of a vacant 50,000 sq ft anchor store and its development into several smaller units.

• Residential development project - advising a privately owned construction and development company on the negotiation and finalisation of project documents for a multi-unit residential scheme in London

• JCT contract dispute - successfully settled a final account dispute at c.£400,000 for a contractor client.

• • Payment application adjudication - preparing for adjudication under the Housing Grants, Construction and Regeneration Act 1996 in respect of a final payment application of c.£360,000, where the employer failed to serve a valid Pay Less Notice in time.

• • Prime Residential construction contract - provided clause-by-clause procurement advice on a c.£3m construction contract for works at a bespoke residence in London including a review of the Schedule of Amendments, Collateral Warranty, and Sub-Contract documentation.

• • Warehouse contract - provided clause-by-clause procurement advice on a c.£2m warehouse scheme, including review of the letter of intent and Schedule of Amendments.
