A prenuptial agreement is a formal contract between couples before marriage, setting out how assets (including future assets, such as inheritance from relatives) is intended to be divided if the relationship ends.
The purpose of entering into a prenup is effectively to protect pre-acquired assets or inheritance.
While not automatically binding in UK courts, a thorough and well drafted agreement with full financial disclosure before signing, carries significant legal weight. There must be no pressure or undue influence to sign with a sufficient period for both parties to get independent legal advice before signing.
The most common reasons for considering a prenuptial agreement include :-
Where one of the parties has or potentially will inherit a significant amount of family money.
Where one of the parties is a lot more wealthy than the other.
Where one of the parties is a significant shareholder in a business.
With a second marriage especially where the parties already have children.

Ideally, you should be thinking of starting the process 3-4 months before the wedding day.
This will ensure you and your partner have sufficient time to discuss, agree and finalise the terms of any prenup, thereby ensuring that it is signed at least 28 days before the wedding (this being the recommended period when entering into prenups).
You will want to avoid anything that suggests any pressure, time wise or otherwise, was exerted. Any suggestion of this could become an issue, if later you need to rely on the prenup.
Fees will be dependent on factors including what your needs are, for example, whether we are drafting the prenuptial agreement or advising on one that has been provided by your partners solicitors, complexity of assets that need to be protected and the terms proposed, as well as the extent to which you and your partner are already in agreement prior to instructing lawyers.
Our hourly fee rates are competitive with similar law firms with similarly experienced and specialist lawyers. Purely as a guide to typical fees where we draft the agreement, these may range between £2,500.00 to £4,000.00 plus VAT.
Yes.
Most prenups wil have a review clause built in which provides a mechanism for both parties to review the terms of the agreement after a period of time, usually between 3-5 years.
In addition prenups will refer to certain events that should trigger a review, for example, the birth of a child or a signifcant change of one party's financial circumstances.
If both parties agree to change the agreed terms, they would then be creating a postnuptial agreement to reflect the new arrangements in the event the marriage breaks down.
It is vital that any agreement to change terms is drafted in clear and comprehensive terms.
