In DC v HJ (Case C-97/22) EU:C:2023:413 , the European Court of Justice (ECJ) has recently confirmed that under the Consumer Rights Directive, if a trader fails to give a consumer the required pre-contract information about their cancellation rights, a consumer can withdraw from the contract without having to pay for the services supplied prior to withdrawal. The same consumer rights apply in UK consumer regulations. Although ECJ rulings are no longer binding on English courts, the latter can take into consideration judgments of the ECJ.

This reinforces why UK businesses should have terms and conditions that comply with UK consumer regulations and the Consumer Rights Act 2015. Differing consumer rights apply depending on whether the contract is formed on the business’s premises, online or on the consumer’s property.


Set out below are some key points:

1. Legal Compliance: Adhering to consumer regulations and the Consumer Rights Act 2015 ensures that businesses operate within the law. It helps prevent legal disputes and potential losses and penalties that could arise from non-compliance, for example te loss suffered set out in the recent ECJ judgment above.    
2. Consumer Protection: These regulations are designed to protect consumers and ensure fair and transparent business practices. By complying with them, businesses demonstrate their commitment to treating customers fairly, which can enhance their reputation and build trust among consumers.

3. Clarity and Transparency: Terms and conditions that comply with consumer regulations help provide clear information to customers about their rights, warranties, refunds, and any potential limitations or exclusions. This transparency helps customers make informed decisions and reduces misunderstandings or disputes.

4. Dispute Resolution: Complying with consumer regulations facilitates smoother dispute resolution processes. It establishes a framework for handling customer complaints and resolving conflicts in a fair and efficient manner, potentially avoiding costly litigation.

5. Competitive Advantage: Demonstrating compliance with consumer regulations can give businesses a competitive edge. It shows potential customers that the business operates responsibly and respects consumer rights, potentially attracting more customers and enhancing loyalty.

6.Legally compliant terms and conditions avoid the time and expense of drawing up specific terms for each individual transaction, they provide certainty that a business will be trading on broadly consistent terms that comply with the business's policies and procedures; and they allow a business to standardise its contracting procedures.

In summary, businesses having terms and conditions that align with UK consumer regulations and the Consumer Rights Act 2015 is crucial for legal compliance, consumer protection, clarity, dispute resolution, and maintaining a competitive advantage in the market.

Consumer rights and remedies cannot be generally contracted out of and must meet statutory requirements for transparency and fairness. Time spent with a solicitor in drawing up standard terms and conditions for use with consumers will be drafted so that they reflect these rules.
