In DC v HJ (Case C-97/22) EU:C:2023:413 , the European Court of Justice (ECJ) has recently confirmed that under the Consumer Rights Directive, if a trader fails to give a consumer the required pre-contract information about their cancellation rights, a consumer can withdraw from the contract without having to pay for the services supplied prior to withdrawal. The same consumer rights apply in UK consumer regulations. Although ECJ rulings are no longer binding on English courts, the latter can take into consideration judgments of the ECJ.

This reinforces why UK businesses should have terms and conditions that comply with UK consumer regulations and the Consumer Rights Act 2015. Differing consumer rights apply depending on whether the contract is formed on the business’s premises, online or on the consumer’s property.

Set out below are some key points:
