We successfully guided our client through two challenging inheritance disputes involving his father and siblings, ensuring their mother’s wishes were respected throughout and a successful financial outcome was achieved.
The client’s father initially brought a claim against his late wife’s estate, seeking full ownership of the family home, despite the Will granting him a life interest. We negotiated a settlement with the father that protected the majority of the estate and secured a fair resolution for our client.
During the process, we discovered a further issue regarding the prima facie entitlement under the Will. Evidence had to be gathered to support the position that the Will’s wording did not reflect the deceased’s true intentions, as she intended for only specific individuals to benefit and her instructions to the will writer clearly identified the intended beneficiaries.
This matter was successfully addressed without having to formally proceed with a rectification application at court.

Investigations – We carried out extensive enquiries into the property’s financial history and previous ownership to confirm the deceased’s contributions. This helped establish that the property rightfully belonged to her and provided a solid foundation for defending against the father’s claims.
Persuasive response – We prepared a robust defence demonstrating that the property belonged solely to the deceased, while highlighting that the father’s position was already well provided for through his life interest. This approach ensured our client’s position was presented clearly and convincingly.
Negotiating a settlement – We secured a realistic and appropriate settlement with the father to resolve the main dispute efficiently. The settlement was structured to allow the remaining dispute between the siblings to be addressed separately, protecting our client’s interests and keeping the estate administration on track. 4. Reviewing the Will file, obtaining evidence and presenting the claim to the opponents – We examined the Will preparation documents and obtained supporting evidence from the Will writer that our client was the intended sole beneficiary. This provided strong proof of the deceased’s true intentions that, reinforcing our client’s entitlement and supporting any future steps to rectify the Will, if an agreement was not forthcoming. After presenting the overwhelming evidence obtained, we secured a favourable settlement for our client as the opponents agreed to vary their inheritance in our client’s favour, without the need to issue court proceedings.
The outcome delivered clear benefits for our client, preserving the estate while resolving the father’s claim without the need for lengthy proceedings or further family conflict. Following this, our client produced evidence demonstrating the deceased’s intention for him to benefit over the other children. Upon review, the siblings conceded, resulting in an increased entitlement. This brought clarity and allowed the estate to be administered efficiently in line with the deceased’s wishes.
