Our client initially sought treatment in 2019 for persistent right knee problems. These issues had been under review for six months, with a conservative approach being adopted. However, by mid-2019, her knee had significantly deteriorated, and she was advised to undergo a total knee replacement.
In July 2019, the procedure was performed, and she was discharged just three days later. At first, her recovery seemed manageable, but only a week later, her wound began bleeding, and her leg gave way. She could no longer bear weight, and was urgently admitted to hospital. Doctors performed a surgical repair – but critical aspects of the procedure were not carried out properly.
Despite undergoing multiple corrective surgeries, her condition could not be salvaged. Ultimately, in 2021, she underwent an above-knee amputation – an outcome that was both devastating and avoidable. She was left with chronic phantom limb pain, severe lower back issues, psychological trauma, and required permanent wheelchair use.
We obtained expert medical evidence confirming that our client’s treatment fell below the standard of care patients are entitled to expect from healthcare professionals. This is known as a ‘breach of duty.’ We further secured evidence that argued, were it not for this breach of duty, it is likely that she would never have required an amputation. Her quality of life, mobility, and independence were irreversibly affected by what should have been routine treatment.
Tragically, our client passed away in 2023 from unrelated causes before her case could conclude. However, her two adult children bravely continued the claim on her behalf. In November 2024, a settlement was successfully negotiated at a roundtable meeting with the defendant. The compensation secured reflects not only her pain and suffering but also the tangible and long-term impact of the failings in her care.
