When a family faces a sudden health crisis, financial worries shouldn't follow. Our client was living in a care home when his wife urgently needed access to their finances to cover his care fees.
A spouse has no automatic legal right to access their partner's finances, even in an emergency. Without an LPA, the family risked falling into arrears on care fees, with no straightforward way to resolve it. Without legal authority to manage his accounts, she faced the prospect of those bills going unpaid, and the stress that comes with it.
Without the right legal documents in place, even accessing funds to pay for care can become impossible. A Lasting Power of Attorney (LPA) gives a trusted person the legal authority to manage someone's finances, and in this case, getting one in place quickly made all the difference.
Key facts:
Client was residing in a care home and unable to manage his own finances
His wife had no legal authority to access or manage their funds
Care home fees were accruing and needed to be settled promptly
No LPA was in place
Speed was critical. LPA applications are submitted to the Office of the Public Guardian (OPG) and registration takes time. Getting the paperwork right first time was essential — any errors would cause costly delays. We also needed to take instructions directly from the client, which meant visiting him in person at the care home.
Our team acted immediately. We travelled to the care home to take instructions, prepared the documentation carefully, and submitted the application to the OPG as quickly as possible. From first instruction to submission, the entire process was completed within three weeks.
The LPA was submitted to the OPG quickly, giving the client's wife the legal authority she needed to manage his finances and settle the outstanding fees once registered.
At Taylor Rose, we know that some situations simply can't wait. Our Private Client team handles LPA applications with urgency and sensitivity — including visiting clients at home, in hospital, or in care settings.
